Ms. Kiley concentrates her practice in general tort litigation having successfully defended numerous high-exposure personal injury cases.  She has successfully managed complex, multi-party litigation. She has diverse experience in areas such as construction negligence, products liability, professional negligence, transportation claims, premises liability, Section 1983 civil rights matters, uninsured/underinsured motorist claims, appeals and insurance coverage.  She also has experience in providing risk exposure and management counsel and in independent claims auditing.

 

Representative Cases

​

Ms. Kiley helped to successfully resolve the E2 Nightclub claims involving twenty-one wrongful death cases and sixty-eight personal injury claims.  The E2 Nightclub incident has been coined the worst Chicago tragedy since the Chicago Fire. 

​

Ms. Kiley also defended a rape victim in a high-profile Section 1983 case whereby the victim’s accused was released from prison and sued Ms. Kiley’s client, the police detectives and the State’s Attorney claiming that the rape was fabricated. This matter involved an appeal and constitutional challenge of the Illinois’ certificate of innocence statute.

Ms. Kiley’s most recent trial victory was a dental malpractice case where the jury found that her client was not guilty only after eleven minutes of deliberation.

Ms. Kiley’s current representative cases include the defense of a franchisee in a storefront crash involving a double leg amputation; the defense of a franchisee in a negligent security case where a store patron was assaulted and subsequently run over by a cab in Chicago’s downtown tourist area; and, the defense of a youth organization in an alleged negligent hiring case involving claims of sexual molestation.

​Ms. Kiley was successful on appeal In Wendy Hartley v. North American Polymer Company, Ltd., et al, 2020 IL App (1st) 192619 (Dec. 3, 2020). The appellate court agreed a settlement of $50,000 between a plaintiff and third-party defendant was not entered in good faith where there was a $1M policy, the settling parties were family members, and there was significant potential culpability of the third-party defendant.

Recognitions

 

Ms. Kiley has repeatedly been selected for inclusion in Illinois Super Lawyers – Rising Stars since 2012. 

​

She has been consistently named an Emerging Lawyer by the Leading Lawyers Network, a distinction given to the top 2% of attorneys under the age of 40.

​

Ms. Kiley was named to the prestigious 2016 class of 40 Under 40 by the Chicago Daily Law Bulletin.
